Welcome to ApnaWorker! These terms and conditions outline the rules and regulations for the use of ApnaWorker's Website, located at https://www.apnaworker.com.
1. Consent & Agreement
By accessing this website, you agree to these terms and conditions. Creating or continuing to use an ApnaWorker account requires explicit acceptance of the current Terms & Conditions and Privacy Policy. This applies to workers, recruiters, employers, and all other account holders, including users who sign up or sign in with Google. If you do not agree, do not create an account or use account-only features.
2. User Accounts
To access certain features of the platform, you must register for an account (typically using Google OAuth authentication).
- You must be at least 18 years old and legally able to enter into a binding agreement to create or use an account.
- You must provide accurate, complete, and current information.
- You are responsible for safeguarding your login credentials.
- You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
3. Your Data, Public Information & Responsibility
You are responsible for the information you submit to ApnaWorker and for deciding whether it is safe and lawful to share. Depending on the feature you use, information may be shown publicly, included in search pages, or made available to other users. Only submit personal information, phone numbers, email addresses, addresses, job details, photos, and other content that you are authorized to share.
- Workers: When you activate a worker listing, your profile details may appear publicly in the worker directory and on profile pages. This may include your name, city or location, skills, rates, availability, bio, and other details you provide. Your contact details, including your phone number, may be displayed or revealed to users so they can contact you.
- Recruiters and employers: Information you add to a job post may appear publicly on the job listing. This may include the job description, location, budget, and any contact details you choose to provide.
- ApnaWorker may use reasonable access controls, but we cannot control copying, screenshots, sharing, or use of information after it becomes visible to another person.
- You should remove or update information that you no longer want to share and report suspected misuse to us. Workers can remove their profile from the directory from the dashboard and can edit or remove their contact details.
- Nothing in these Terms removes any responsibility ApnaWorker has under applicable law for its own handling of personal data.
4. Guidelines for Recruiters & Employers (Clients)
Recruiters and employers posting jobs on ApnaWorker agree to the following terms:
- You will only post genuine, active job openings. Fake, misleading, or deceptive jobs are strictly prohibited.
- You will not post jobs promoting illegal activities, multi-level marketing (MLM) schemes, or high-risk financial setups.
- You agree to handle all financial agreements and payments directly and honestly with the worker. ApnaWorker takes no commission and is not responsible for payment processing.
5. Guidelines for Job Seekers (Workers)
Workers creating profiles on ApnaWorker agree to the following terms:
- You will represent your skills, qualification, portfolio, location, and rates honestly.
- You will not impersonate any person or entity, or use fake documents/credentials.
- You will maintain professional conduct when interacting with clients and respect scheduled appointments.
- You must accept the worker profile disclosure before your listing can be activated in the public worker directory.
6. Prohibited Activities
You are prohibited from:
- Using the site for any unlawful purpose or to solicit others to perform unlawful acts.
- Harassing, abusing, insulting, harming, defaming, or intimidating other users.
- Using automated systems, scrapers, crawlers, or bots to fetch profiles or data from the website without our explicit permission.
- Circumventing or interfering with security features of the website.
7. Intellectual Property & License
Unless otherwise stated, ApnaWorker and/or its licensors own the intellectual property rights for all material on ApnaWorker. All intellectual property rights are reserved. You may access this from ApnaWorker for your own personal use subjected to restrictions set in these terms and conditions.
8. Disclaimer of Warranties & Limitation of Liability
ApnaWorker acts solely as an online directory and matching platform. We do not hire workers, control job listings, or verify backgrounds comprehensively.
To the maximum extent permitted by applicable law, the platform is provided "as is" and "as available". ApnaWorker disclaims warranties of any kind and is not liable for direct, indirect, incidental, or consequential damages (including loss of money, reputation, or safety) resulting from the use of, or inability to use, our platform, or the conduct of other users. Nothing in these Terms limits rights or liability that cannot lawfully be excluded.
9. Account Suspension & Termination
We reserve the right, without prior notice or liability, to suspend or terminate your account and restrict your access to ApnaWorker if you violate these terms and conditions, post fraudulent content, or engage in behavior that harms the community or safety of the platform.
10. Applicable Law & International Users
These Terms are governed by the laws of India, without regard to conflict of law principles. ApnaWorker is used by people in multiple countries. Mandatory consumer protection, privacy, employment, and other rights that apply in your location remain unaffected.
